PostHeaderIcon Amendments of Stamp Duties Act

On 16 December 2013, Cabinet approved retrospective amendments to Section 60A(1) of the Stamp Duties Act 1923 to confirm and reflect RevenueSA's long-standing interpretation of this section. That is, that the 'date of sale' is the date the property in question is conveyed or transferred.

PostHeaderIcon First Home & Housing Construction Grants (Eligibility Criteria) Amending Act 2013

The First Home and Housing Construction Grants (Eligibility Criteria) Amending Act 2013 and the Succession Duties Repeal Act 2013 were assented to by His Excellency the Governor today.

The First Home and Housing Construction Grant (Eligibility Criteria) Amending Act 2013 adjusts the eligibility criteria of the First Home And Housing Construction Grants Act 2000 to ensure the Government's policy of providing the Housing Construction Grant to purchasers of new homes is achieved where other parties may also be eligible. The Succession Duties Repeal Act 2013 extinguishes any residual matters that may still arise even though succession duties were abolished as from 1 January 1980. See Information Circular 67 for further details.

PostHeaderIcon Real Estate Reforms - General red tape redcution

Real Estate Reforms take Effect January 1st 2014!

Along with the bigger changes, there are some minor changes desiged to reduce red tape . They are

1) Agends will have up to 48 hours to give their Vendor a copy of the Sales Agency Agreement (or variation of the Agreement)

2) Deliver the certificate which accompanies the Vendor's Statement

3) the Form R3 will no longer have to be given to every propective purchaser. It will however have to be displayed prominantly at open inspections and be sufficient copies for interested persons to take a copy.
